Who these terms are with
These Terms of Service are an agreement between you and VF Technologies Pty Ltd (ABN 46 669 823 036), the Australian company that operates Follower Watch. They apply to the Follower Watch website, browser extension, mobile applications, APIs, account services and email alerts (together, the Service).
Acceptance of terms
By accessing or using the Service, you agree to these terms and our Privacy Policy. If you use the Service for an organisation, you confirm that you have authority to bind that organisation. If you do not agree, do not use the Service.
The Service
Follower Watch helps you look up Instagram profiles, create follower and following snapshots, compare changes over time and configure alerts. Features, limits and supported platforms may differ between the website, extension, mobile app, free access and paid plans. Results may be incomplete, delayed or unavailable because they depend on third-party systems, network conditions and the quality of available data.
Accounts and security
You are responsible for the accuracy of information supplied through your account and for keeping your sign-in methods and devices secure. You must promptly notify us if you believe your account has been compromised. You may not transfer, sell or share access in a way that defeats plan limits or security controls.
Acceptable use
You must use the Service lawfully and in accordance with Instagram's terms and any other applicable third-party terms. You must not use it to stalk, harass, threaten, discriminate against or unlawfully profile a person; invade privacy; obtain unauthorised access; scrape or monitor information you are not permitted to access; evade rate limits or technical controls; interfere with the Service; distribute malware; or resell or reverse engineer the Service except where the law cannot prohibit that activity. You are responsible for how you use information presented by the Service.
Third-party services
Follower Watch is an independent product and is not sponsored, endorsed by or affiliated with Instagram or Meta. Instagram and other third-party services may change, restrict or discontinue access at any time. Your use of those services remains subject to their terms, and we are not responsible for third-party accounts, content, actions or availability.
Subscriptions, billing and cancellation
Prices, billing periods, included features and renewal terms are shown before purchase. Recurring subscriptions renew until cancelled. You can manage or cancel an eligible subscription through the account controls or the payment platform used for the purchase. Cancellation ordinarily stops future renewal and does not retrospectively refund an already-started billing period unless required by law or stated otherwise at purchase. Deleting your Follower Watch account cancels an associated active recurring Stripe subscription. Nothing in these terms excludes refund or other rights that cannot lawfully be excluded, including rights under the Australian Consumer Law.
Intellectual property
VF Technologies Pty Ltd and its licensors retain all rights in the Service, including its software, design, branding and documentation. These terms give you a limited, revocable, non-exclusive and non-transferable right to use the Service for its intended purpose. They do not transfer ownership of the Service or of third-party content.
Availability and changes
We may update, suspend or discontinue features, impose reasonable limits, or perform maintenance. We do not promise that the Service will always be available, error-free or compatible with every Instagram or device change. Where reasonably practicable, we will provide notice of material changes affecting an active paid service.
Disclaimers
To the extent permitted by law, the Service is provided “as is” and “as available”. We do not guarantee the accuracy, completeness, order or timeliness of Instagram information or that a scan or alert will identify every change. You should independently verify information before relying on it. Any guarantees, warranties or remedies that cannot legally be excluded remain in effect.
Liability
To the maximum extent permitted by law, VF Technologies Pty Ltd is not liable for indirect, incidental, special or consequential loss, loss of profits, loss of opportunity, loss of data, or loss caused by third-party services or unauthorised use of your account. Where liability cannot be excluded but can lawfully be limited, our liability is limited, at our option, to resupplying the affected service or paying the reasonable cost of having it supplied again. This section does not limit liability that cannot lawfully be limited.
Suspension and termination
You may stop using the Service at any time and may delete your account through the available account controls. We may suspend or terminate access where we reasonably believe you have breached these terms, created security or legal risk, failed to pay applicable charges, or misused the Service. Provisions intended by their nature to survive termination continue to apply.
Governing law
These terms are governed by the laws applicable in Australia, without excluding any mandatory consumer protections that apply where you live. Courts with jurisdiction under those laws may hear disputes. Before commencing formal proceedings, each party should make a reasonable attempt to resolve the dispute directly.
Changes and contact
We may update these terms from time to time by publishing the revised version and changing the date above. If a change is material, we will take reasonable steps to provide additional notice.
